Dismissal based on a criminal record: the Commission wins a case before the Human Rights Tribunal

An employee dismissed because of his criminal record was attributed more than 12 000$ in damages by the Human Rights Tribunal. "This judgment confirms that discrimination based on a person’s previous conviction for an offense unrelated to the employment is a practice prohibited by the Charter of Human Rights and Freedoms.

Montréal, June 7, 2017–An employee dismissed because of his criminal record was attributed more than 12 000$ in damages by the Human Rights Tribunal. "This judgment confirms that discrimination based on a person’s previous conviction for an offense unrelated to the employment is a practice prohibited by the Charter of Human Rights and Freedoms. We hope that this decision will convince employers of the importance to avoid stigmatization of people who have been convicted in the past" said Tamara Thermitus Ad.E. president of the Commission.
